The sale of Real Estate by the Sheriff is done pursuant to two Wisconsin Statutes, specifically Chapter 815 and Chapter 846. The first step in these proceedings is normally a small or large claims action, depending upon the amount owed.
Once the matter proceeds through the court system and the court orders a sale, the Sheriff will be contacted to set up a sale date. Once a date is set, the plaintiff or plaintiff's attorney will provide the Sheriff with a Notice of Mortgage Foreclosure of Sheriff's Sale.
